Terms & Conditions

Booking Conditions 

The following terms and conditions (the “Booking Conditions”) apply to all travel and travel-related services or arrangements offered for sale through Travelodeal.ca. Travelodeal.ca is operated by Travelodeal Limited. These Booking Conditions, together with the Booking Summary and/or Confirmation Invoice and any booking-specific term expressly communicated before acceptance, form the basis of your contract. “Service”, “Services”, “Travel Service” and “Travel arrangements” include flights, accommodation, resorts, transfers, excursions, car rentals, rail travel, cruises, ferries, motor coaches and any other travel-related service. References to a “trip”, “booking”, “contract”, “holiday” or “vacation” mean the applicable Travel Service or connected group of Travel Services, unless otherwise stated. 

We are Travelodeal Limited. “We”, “us”, “our” and “Travelodeal” mean Travelodeal Limited, company number 09061889, whose registered office is at Level 5A, Maple House, 149 Tottenham Court Road, London W1T 7NF, United Kingdom. We accept bookings subject to these Booking Conditions. Except where expressly stated, these Booking Conditions apply to Travel Services booked with us and which we agree to arrange, provide or perform, as applicable. 

“You” and “your” mean the purchaser, Lead Traveller and every Traveller named in the Booking, including anyone added or substituted later. You must read these Booking Conditions and the Booking Summary and/or Confirmation Invoice carefully because they set out the parties’ rights and obligations. By confirming the Booking through an affirmative online acceptance, recorded verbal authorization, signed authorization, email confirmation or secure payment link, you acknowledge that you had a reasonable opportunity to review and accept the applicable documents. The Lead Traveller confirms that they have authority to accept them for every Traveller named in the Booking. 

SUPPLIER CONDITIONS: Travel Services are provided by independent Suppliers and are subject to the applicable operational conditions of those Suppliers, including rules concerning check-in, baggage, occupancy, security deposits, conduct, health, safety and use of the Travel Service. By confirming the Booking, you agree to comply with those applicable Supplier conditions. Any booking-specific price, payment, cancellation, refund or change restriction forms part of the Booking only where it is contained in these Booking Conditions, the Booking Summary and/or Confirmation Invoice, or was otherwise clearly communicated before acceptance. Supplier conditions do not limit any mandatory consumer right or any obligation that applicable law places directly on Travelodeal. 

In these Booking Conditions, a “package” means a combination of two or more Travel Services sold together and treated as a package under the law applicable to the Booking. Whether a Booking is legally a package depends on its contents and applicable law, not only on the label used. 

You must be of a legal age at the time of booking and possess the legal capacity and authority to act and travel as the lead name on the booking. We will only deal with the lead name on the booking in all correspondence. 

A contract is formed when we issue the Confirmation Invoice or other written confirmation. The contract consists of these Booking Conditions, the Booking Summary and/or Confirmation Invoice and any booking-specific condition expressly communicated before acceptance. We will send the Booking Summary and/or Confirmation Invoice and access to the applicable Booking Conditions in a form that can be retained and printed, promptly after confirmation and within any mandatory legal deadline. Check names, dates, destinations, prices, room or cabin types, flights and other details immediately and notify us promptly of an error. A request to correct an error does not remove any mandatory consumer right, although a Supplier may charge for a permitted correction or require cancellation and rebooking. 

A Supplier may impose operational rules for its Travel Service, including check-in, baggage, occupancy, security-deposit, conduct and schedule rules. A booking-specific payment, cancellation, refund or change restriction forms part of the Booking only where it is contained in these Booking Conditions, included in the Booking Summary and/or Confirmation Invoice, or otherwise clearly communicated before acceptance. A carrier or Supplier may also have a lawful limitation under an applicable international convention. Nothing in a Supplier rule removes an obligation imposed directly on Travelodeal by law, and no blanket exclusion applies merely because a Supplier becomes insolvent or bankrupt. 

By making a Booking, you agree for yourself and the Travellers you represent to be bound by the contract documents described above. If you book for another person, you must provide that person with the Booking Summary and/or Confirmation Invoice, these Booking Conditions, applicable Supplier information and material updates. Nothing in these Booking Conditions requires arbitration, waives a lawful class-proceeding right, restricts a mandatory court or tribunal, or waives a cardholder’s right to contact a card issuer where such a restriction is prohibited or inoperative. 

Travel is personal and individual expectations differ. Descriptions, photographs and ratings supplied by independent third parties are illustrative unless a feature is expressly guaranteed in the Booking Summary and/or Confirmation Invoice. We take reasonable care when presenting material information but do not guarantee that an illustrative image will show the exact room, layout, view, furnishings or seasonal condition. This paragraph does not exclude liability for a misleading representation for which Travelodeal is legally responsible. 

Lead Passenger Responsibility for Group Bookings  

When a group booking is made, the lead passenger (the individual confirming the booking) assumes full responsibility for all payments and liabilities associated with the booking, including those related to accommodations, activities, transportation, and any other services included in the booking. The lead passenger is solely responsible for ensuring that all group members comply with the terms of the booking, including payment of any additional costs resulting from cancellations, no-shows, or modifications by any group member. 

In the event that any group member cancels or refuses to pay, the lead passenger agrees to cover the full cost of the booking, including any additional charges that arise due to changes in room allocation or services. The cancellation or non-payment of any group member does not relieve the lead passenger from their financial obligations under this agreement. 

Partial Cancellation of Group Bookings 

Partial cancellation of an individual Traveller, room, flight, hotel, cruise, transfer, travel date or other component of a connected group Booking is not allowed unless the Booking Summary and/or Confirmation Invoice expressly permits separate cancellation, Travelodeal agrees otherwise in writing, or mandatory law requires otherwise. A request to cancel any part of a connected group Booking may therefore be treated as cancellation of the entire Booking. If Travelodeal agrees to remove a Traveller or Travel Service, the remaining Booking may be repriced for revised occupancy, allocation, linked rates and Supplier pricing, and the disclosed cancellation charges will apply to the removed part. 

Payments, Refunds and Payment Disputes 

Payments made for a group Booking are refundable only to the extent stated in the Booking Summary and/or Confirmation Invoice, applicable disclosed Supplier conditions and mandatory law. Withdrawal, non-payment or disagreement by one group member does not by itself entitle the Lead Traveller or another payer to a refund. A payment dispute or chargeback does not by itself cancel the Booking. Nothing in these Booking Conditions waives a lawful chargeback or statutory remedy. A Traveller must not obtain duplicate reimbursement for the same loss from Travelodeal, a Supplier, card issuer, insurer or another source. 

Legal Action for Payment Disputes 

If a valid amount remains unpaid after notice and any cure period required by law, Travelodeal may use a lawful collection process or legal proceeding to recover it. The Lead Traveller is responsible only for reasonable, documented recovery costs that applicable law permits Travelodeal to recover. Travelodeal will not impose a penalty merely because a consumer exercised a lawful complaint, cancellation or payment-dispute right. 

 

Luxury and Bespoke Bookings 

Where a Booking includes a cruise, luxury hotel or resort, villa, private residence, premium cabin, private transfer, private tour, special event or tailor-made itinerary, any stricter payment, cancellation, amendment, occupancy, security-deposit or operational condition applies only where it is contained in these Booking Conditions, included in the quotation, Booking Summary and/or Confirmation Invoice, or otherwise clearly communicated before acceptance. 

Luxury and bespoke arrangements may involve limited inventory and services created specifically for the traveller. By confirming the booking, you authorize us to make the disclosed commitments to the relevant Suppliers. 

The quotation or booking confirmation may identify particular components as immediately non-refundable, non-transferable or non-changeable. By confirming the booking, you authorize us to secure those components and acknowledge that the applicable Supplier commitment may be made before final payment is due. 

A bespoke itinerary is priced as a connected arrangement. A requested change to one component may require the entire itinerary to be repriced and may result in the loss of linked rates, upgrades, credits, complimentary benefits or other negotiated advantages. 

If the Lead Traveller is resident in Canada when the Booking is made, the contract is governed by the laws of that province or territory and the federal laws of Canada applicable there. A claim may be brought in any court, tribunal or consumer process having mandatory jurisdiction, including a competent forum in the consumer’s home province or territory. If the Lead Traveller is not resident in Canada, the contract is governed by the laws of England and Wales and its courts have non-exclusive jurisdiction, subject to any mandatory law or forum right. 

Nothing in these Booking Conditions limits a mandatory consumer-protection, cancellation, refund, rebooking, compensation, privacy, payment-dispute or other right under applicable federal, provincial or territorial law, an applicable international convention or card-network rules.

You will be required to pay us a deposit in accordance with instructions we give you at the time of booking. FINAL PAYMENT IS DUE 80 DAYS PRIOR TO DEPARTURE unless otherwise specified. You will be advised of all deposit details, holiday costs and costs of any additional services in addition to any third-party supplier costs which are either payable in full and/or non-refundable and non-changeable prior to booking. The balance of the price of your travel arrangements must be paid in full no later than the due date shown on your confirmation invoice. However, with any element of your booking, a supplier may ask for full balance payment at an earlier time than Travelodeal’s balance due date (e.g. scheduled airline tickets) and, if this occurs, we will give you as much notice as possible and you will be advised of this possibility prior to booking. The additional amount paid will form part of your non- refundable deposit. If you would prefer, you can look at alternative arrangements rather than make an earlier payment (on the proviso that no cancellation charges would apply), but this could incur extra overall costs. If we do not receive any payment due on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges as set out in below sections will apply. 

High-Value and Supplier Payments 

For high-value bookings, we may require enhanced identity verification, cardholder confirmation, proof of billing address, signed payment authorization or payment by bank transfer before funds are accepted or applied. 

Air tickets, cruises, villas, private residences, premium accommodation, festive or peak-season stays, private transfers, event tickets and tailor-made services may require immediate or staged payment and may become non-refundable and non-changeable when confirmed with the Supplier. 

Where we act as agent and a Supplier controls or has received the funds, a refund may require the Supplier’s approval and return of the relevant funds to us, subject only to booking-specific restrictions disclosed before acceptance. This does not delay or remove a refund obligation that applicable law places directly on Travelodeal. 

Any refund, credit or compensation will take account of amounts already returned, credited, reimbursed or otherwise recovered for the same loss. A traveller may not recover more than once for the same loss. 

Card Payments, Authentication and Payment Disputes 

By providing payment-card details, approving a telephone payment, signing a payment authorization or completing a secure payment link, the cardholder authorizes Travelodeal Limited to charge the amounts and instalments identified in the quotation, payment schedule and booking confirmation. The cardholder confirms that they are authorized to use the payment card and that the cardholder name, billing address and contact details supplied are accurate. 

Before payment is processed, the Lead Traveller and cardholder must be given access to these Booking Conditions and the Booking Summary and/or Confirmation Invoice showing the total price, currency, payment schedule and material cancellation, amendment and refund conditions. Acceptance may be recorded by an unticked checkbox, secure-payment confirmation, email confirmation, digital signature or recorded verbal authorization. We may retain the accepted version, Booking Summary and/or Confirmation Invoice, timestamp, IP address, device information, authentication result, communications and delivery records as evidence of authorization and acceptance. 

The payment-card statement may display “Travelodeal”, “Travelodeal Limited” or another billing descriptor disclosed during payment. The cardholder should contact us promptly if a transaction is not recognized. 

A payment dispute or chargeback does not by itself cancel a booking. Unless the booking is separately cancelled in accordance with these Terms, Supplier commitments, payment obligations and cancellation charges may continue to apply. Before raising a dispute concerning cancellation, non-receipt, quality, description or refund, the traveller should contact Travelodeal and provide a reasonable opportunity to investigate and resolve the matter. This does not restrict any mandatory right to contact a card issuer or exercise a right under applicable law or card-network rules. 

The traveller must not obtain duplicate reimbursement for the same loss through a card issuer, insurer, Supplier, travel-protection provider or any other party. Any amount recovered from another source must be disclosed and will be deducted from any amount otherwise payable. Where a chargeback is withdrawn, reversed or determined in Travelodeal’s favour, any legitimate outstanding amount due under the booking remains payable, together with reasonable recovery costs only where permitted by law. 

Booking-Specific Non-Refundable Charges 

Where the quotation, Booking Summary, Confirmation Invoice or another pre-acceptance communication identifies a component as non-refundable, non-transferable or non-changeable, the disclosed restriction applies to that component. By confirming the Booking, the Traveller authorizes the disclosed Supplier commitment. A restriction is not binding merely because it appears in an undisclosed Supplier term, and mandatory legal rights always prevail. 

Refund Processing 

Where a refund is approved and payable by Travelodeal, it will ordinarily be initiated to the original payment method after the amount has been confirmed and, where we act as agent, after the relevant Supplier has approved and returned the funds to us, except where applicable law requires Travelodeal to refund earlier or directly. We will provide written confirmation when the refund is initiated. The time taken for the refund to appear after initiation is controlled by the card issuer, bank or payment provider and is outside our control. 

Any partial refund will reflect the refundable components of the booking, less disclosed cancellation or amendment charges and amounts already returned, credited or recovered for the same loss. Nothing in this provision limits a mandatory refund deadline or remedy under applicable law.

 

You will be notified price of your chosen travel arrangements at the time of booking. The price (may be termed as trip price or total amount of holiday or package price or prices for arrangements anywhere in the conditions), as indicated on your booking confirmation may include a flight as well as applicable airfare taxes, except for some destinations' departure tax. Some countries charge a departure tax at the airport prior to boarding the return flight. This is paid locally and, in some cases, must be paid in local currency.  

Other tour services and accommodations are included in your price only if they are indicated on your itinerary. These arrangements inclusions/rates are based on inclusions/prices at time of purchase and are subject to change without notice. You may incur additional expenses that are not included in the price, including but not limited to resort fees, destination taxes and environmental fees. No promise of a discount or refund will be binding on us unless confirmed by us in writing. 

WE MAY CHANGE AN ADVERTISED PRICE BEFORE THE BOOKING IS CONFIRMED. AFTER CONFIRMATION, THE CONFIRMED PRICE WILL NOT BE CHANGED EXCEPT FOR A LAWFUL GOVERNMENT TAX OR CHARGE DISCLOSED AS VARIABLE, A CHANGE ACCEPTED BY YOU, OR AN OBVIOUS AND MATERIAL ERROR HANDLED AS SET OUT BELOW. 

Special Note: We take reasonable care to publish accurate pricing. If a confirmed price contains an obvious and material error that a reasonable person would recognize, we will notify you promptly. You may accept the corrected price or cancel the affected Travel Service for a full refund of amounts paid for it. We will not use this clause to impose an ordinary price increase after confirmation or after a service has been used. 

 

A. Cancellation by you: 

A partial cancellation is not allowed unless the Booking Summary and/or Confirmation Invoice expressly permits it, Travelodeal agrees otherwise in writing, or mandatory law requires otherwise. A request to cancel any Traveller or Travel Service forming part of a connected Booking may be treated as cancellation of the entire Booking. To cancel, the Lead Traveller must notify us in writing at admin@travelodeal.com or through the customer-service contact method shown on Travelodeal.ca. Cancellation is effective when received, subject to reasonable identity verification. If an agreed partial cancellation is permitted, the remaining arrangements may be repriced and the applicable disclosed charges will apply. 

Because Travelodeal and Suppliers may incur costs and make non-refundable commitments when a Booking is confirmed, the cancellation charges below may apply. A flight or other Travel Service is non-refundable only where the applicable restriction was clearly disclosed before acceptance in the Booking Summary and/or Confirmation Invoice or is imposed by mandatory law. Cancellation charges are calculated on the total price of the affected Booking or component and will not be counted twice. 

In the event of a cancellation of a booking secured by a low deposit, we reserve the right to collect the balance of the full deposit amount. You may be able to make a claim under your travel insurance policy if your cancellation falls within the conditions of the policy. Claims must be made directly to the insurance company concerned. 

Unless a booking-specific condition was disclosed for a particular Travel Service, the following default cancellation charges apply. No separate amendment fee is added merely because the Booking is cancelled: 

  1. 81 days or more before departure – the non-refundable deposit shown in the Booking Summary and/or Confirmation Invoice, including any separately disclosed Supplier commitment without double counting. 

  1. 46 to 80 days before departure – 50% of the total Booking price. 

  1. 16 to 45 days before departure – 75% of the total Booking price. 

  1. 0 to 15 days before departure or no-show – 100% of the total Booking price, subject to any mandatory refund or cancellation right. 

 

Note: A higher deposit or stricter Supplier condition applies only to the relevant Travel Service where it was clearly disclosed before acceptance in the Booking Summary and/or Confirmation Invoice. Supplier-specific charges are included in, not added on top of, the applicable cancellation charge unless the Booking Summary expressly applies a separate condition to that component. Total cancellation charges will never exceed the total Booking price. 

The cancellation charge reflects the refundable and non-refundable parts of the Booking and reasonable commitments arising from cancellation. Any refundable balance will be returned after applying the valid charge. Insurance premiums and a separately disclosed administration fee already earned for a completed service are refundable only where the applicable policy or law requires. 

If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges. We will deduct the cancellation charge(s) from any monies you have already paid to us. 

 

 B. Changes by you: 

 

Should you wish to make any changes to your confirmed holiday, you must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests.  A change of holiday dates will normally be treated as a cancellation of the original booking and rebooking in which case cancellation charges will apply. Changes may result in the recalculation of the holiday price where, for example, the basis on which the price of the original holiday was calculated has changed. 

In the event we can meet your requested change, you will have to pay an administration charge of CAD 95 per person per change, plus any further costs we incur in making this alteration, together with all costs or charges imposed by any suppliers. You should be aware that these costs generally increase significantly the closer to the departure date that changes are made, and you should contact us as soon as possible. Please note that most airlines do not permit name changes for any reason after confirmation. If you wish to make a name change, this will be treated as a cancellation and re-booking. You will have to forfeit the amount you have already paid for your flight and pay the full, current cost of the flight again. Your ability to rebook will be subject to a seat being available for a new reservation. Where we and the travel supplier are unable to assist with making a requested change, and you do not wish to proceed with the original booking we will treat this as a cancellation by you. 

Note: A clearly disclosed non-refundable or non-changeable component may incur a charge of up to 100% of that component. That component-specific charge will not be counted twice or added in a way that causes total cancellation charges to exceed the total Booking price. 

Cruise, Luxury and Bespoke Cancellation Conditions 

Cruises, villas, private residences, yachts, premium rooms, festive or peak-season accommodation, safaris, private transfers, event tickets and tailor-made arrangements may be subject to cancellation charges of up to 100% from confirmation. Any stricter Supplier condition disclosed before booking will apply to the relevant Travel Service. 

A requested change to a bespoke itinerary may require the itinerary to be repriced in full. Previously negotiated rates, linked arrangements, upgrades, complimentary benefits or other inclusions may be lost when any component is changed.

If we cancel your booking 

(i) We reserve the right to cancel your booking. We will not cancel less than 30 days before your departure date, except for unavoidable and extraordinary circumstances, or failure by you to pay the final balance. 

(ii) Unavoidable and extraordinary circumstances means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken.  

(iii) If your holiday is cancelled you can either have a refund of all monies paid or accept an alternative holiday of comparable standard from us if we offer one (we will refund any price difference if the alternative is of a lower value). 

(iv) In the event a refund is paid to you, we will pay compensation as detailed below except where the cancellation is due to unavoidable and extraordinary circumstances (see definition above).

If we change your booking 

a) It is a term of your booking that we are able to make changes to any aspect of your booking. If the change is insignificant, we will ensure that you are notified about it. Examples of insignificant changes include alteration of your outward/return flights by less than 12 hours, changes to aircraft type, change of accommodation to another of the same or higher standard, changes of carriers, change of value added benefits such as a romantic dinner.   

b) If we are constrained by circumstances beyond our control to alter significantly any of the main characteristics of the travel services that make up your package you will have the rights set out below: 

i) We will contact you and you will have the choice of accepting the change or having a refund of all monies paid. You can also accept an alternative holiday, where we offer one (we will refund any price difference if the alternative is of a lower value). We will tell you the procedure for making your choice. Please read any notification of changes carefully and respond promptly as if you do not respond to us within the timescale given your booking may be cancelled. 

 ii) If you choose to accept a refund we will pay compensation as detailed below except where the significant change is due to unavoidable and extraordinary circumstances, which means a situation beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. 

Please Note: The compensation that we offer does not exclude you from claiming more if you are entitled to do so.

Cruise and Luxury Substitutions 

Cruise operators may change a vessel, port, route, sailing time, docking point, cabin allocation, dining arrangement, excursion or itinerary sequence because of weather, water levels, navigation, safety, security, health, technical, port, government or operational requirements. 

Luxury inventory may become unavailable because of operational, ownership, maintenance, security, weather, government or Supplier circumstances. Where reasonably available, we may provide a comparable hotel, suite, villa, vessel, cabin, transfer, guide or experience. 

Comparability will be assessed by reference to the overall category, official or Supplier rating, value, location, size, privacy, core amenities, service level and main purpose of the booking. Every feature need not be identical. A substitute of reasonably comparable overall standard and value will normally be treated as an insignificant change. If an alternative is materially inferior, any price adjustment or remedy required by applicable law will be provided. 

We clearly instruct all our travelers to have comprehensive Travel Insurance prior to travel. We recommend this is purchased along with your holiday for immediate coverage. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if you are unable to provide details to authorities of insurance or denial of entry for any reason. If you choose travel without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available. 

If you have any special requests, you must advise us at the time of booking (e.g. Diet, room location, a particular facility at a hotel etc.).Whilst we will endeavour to pass any reasonable requests on to the relevant Supplier, no guarantee that any request will be met can be given and we will have no liability to you if they are not. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We do not accept bookings that are conditional upon any special request being met. 

 

Luxury Accommodation and Cruise Requests 

A specific room, suite, villa, residence, building, floor, view, bedding, terrace, pool, beach location, cabin number, deck, dining time, adjoining room, early check-in, late check-out, upgrade, amenity, vehicle, guide or driver is a request only unless expressly confirmed as guaranteed in writing. 

Complimentary upgrades, credits and amenities are subject to availability, have no cash value and are not refundable if withdrawn, substituted or unavailable. 

No. Section 9 in the R3 document should be replaced before publication. 

Problems include: 

  • “Disinfection” should be “Disinsection.” 

  • Airlines do not have one universal 32-week pregnancy limit.

Health, vaccination and entry requirements may vary according to the traveller’s destination, transit points, nationality, medical circumstances and itinerary and may change at short notice. Each traveller is responsible for checking and complying with all mandatory health requirements applicable to the journey, including any required vaccination, testing, health declaration, medical certificate or International Certificate of Vaccination or Prophylaxis. 

Before booking and again before departure, travellers should review the health information contained in the Government of Canada’s Travel Advice and Advisories, consult the appropriate destination or transit-country authorities and, where appropriate, contact the relevant embassy or consulate. 

Travellers should consult a qualified healthcare professional or travel health clinic, preferably at least six weeks before departure, for personalized advice concerning vaccinations, medication, existing medical conditions and fitness to travel. Travelodeal does not provide medical advice. Decisions concerning vaccinations, medication and fitness to travel must be made by the traveller in consultation with an appropriately qualified healthcare professional. 

Each traveller is responsible for ensuring that they are medically fit to undertake the booked Travel Services and for carrying sufficient prescribed medication and any required supporting documentation. Medication should be carried in accordance with applicable governmental, security and Supplier requirements. 

If a traveller has a medical condition, disability, reduced mobility, pregnancy or other circumstance that may affect their ability to use a Travel Service, they should inform Travelodeal before confirming the Booking and provide relevant information reasonably requested for the purpose of arranging assistance. Requests for particular assistance or facilities are subject to confirmation by the relevant Supplier. Nothing in this clause limits any accessibility, accommodation or consumer right that cannot lawfully be excluded. 

Aircraft Disinsection 

Some countries require aircraft to undergo disinsection to control insects that may carry disease or present an agricultural risk. Disinsection may involve the use of an aerosol insecticide while passengers are on board, treatment before passengers board or treatment of the aircraft’s internal surfaces with a residual insecticide. 

Canada does not generally require disinsection of aircraft arriving in or departing from Canada, but aircraft may be required to comply with the laws of another country. Travellers with respiratory conditions, allergies or other sensitivities should consult their healthcare professional and contact the operating airline before travelling. Further information is available from Transport Canada. 

Travelling While Pregnant 

A pregnant traveller should consult a qualified healthcare professional before booking and travelling and should ensure that suitable travel insurance covers pregnancy-related medical treatment, childbirth, premature delivery and care for a newborn where required. Many insurance policies do not automatically provide such coverage. 

Airlines, cruise lines and other Suppliers apply their own pregnancy, gestational-age, fitness-to-travel and medical-documentation requirements. These requirements vary between Suppliers and may depend on the route, length of journey, stage and circumstances of the pregnancy. A Supplier may require a recent medical certificate or may refuse carriage after a specified stage of pregnancy. 

The traveller must check the applicable Supplier’s requirements before booking and again before departure and must obtain any required medical certificate or other documentation within the period specified by that Supplier. A medical certificate does not guarantee carriage, as the Supplier retains responsibility for deciding whether its applicable health and safety requirements have been satisfied. 

To the fullest extent permitted by applicable law, Travelodeal is not responsible for a refusal of carriage or interruption of travel resulting from the traveller’s medical condition, pregnancy, lack of required documentation or failure to comply with an applicable Supplier requirement. Cancellation, amendment and refund rights will be determined by these Booking Conditions, the Booking Summary and/or Confirmation Invoice, any booking-specific restriction communicated before acceptance and applicable law. Nothing in this clause excludes liability arising from Travelodeal’s breach of its legal obligations or limits a right that cannot lawfully be excluded.

It is your responsibility to ensure that you and every person named on the Booking possess all documents and identification required for departure, entry, transit and travel through every country or region included in the itinerary. Depending on the traveller’s nationality, residence, personal circumstances and itinerary, these may include a valid passport, visa, electronic travel authorization, permit, biometric requirement, vaccination or medical certificate, proof of insurance, parental consent documentation and any other document required by a government authority, carrier or Supplier. 

Passport-validity and entry requirements vary between destinations and may change at short notice. Many countries require a passport to remain valid for a specified period after the traveller’s intended departure from that country; there is no universal six-month requirement. Before confirming the Booking and again before departure, you must check the current entry and exit requirements for every destination and transit point using the Government of Canada’s Travel Advice and Advisories and the relevant embassy, consulate or government authority. 

You are responsible for obtaining the required documents in sufficient time and ensuring that they are complete, accurate, undamaged and valid for the entire journey. You are responsible for the reasonable costs and losses directly resulting from your failure to comply with applicable passport, visa, health, immigration or other travel-document requirements, except to the extent that the failure was directly caused by Travelodeal’s breach of its legal obligations. 

Canadian citizens and permanent residents are encouraged to use the Government of Canada’s free, voluntary and confidential Registration of Canadians Abroad service, which allows the Government of Canada to provide important information and assistance during emergencies. 

Information concerning Canadian passport applications is available through the Government of Canada’s Canadian Passport Services. Travellers should not travel with a damaged passport, as they may experience delays, be denied boarding or entry, or have the passport seized by border authorities. 

To the fullest extent permitted by applicable law, Travelodeal is not responsible where a traveller is denied boarding, transit or entry because the traveller does not possess the correct, complete and valid passport, visa, authorization or other required travel documentation. This applies to all destinations and transit points, including where the traveller does not intend to leave the aircraft, ship, train, airport, port or other carrier facility. Nothing in this clause excludes or limits any liability or consumer right that cannot lawfully be excluded.

If you have a complaint about any of your arrangements, you must notify Travelodeal by e-mail at admin@travelodeal.com. A problem that is capable of being corrected during travel must be reported promptly to both Travelodeal and the relevant Supplier, ordinarily within 24 hours after you become aware of it, so that a reasonable opportunity is provided to investigate and correct the issue. A formal post-travel complaint should be submitted in writing within 28 days after completion of the relevant Service and should include the booking reference, a clear description of the issue and supporting evidence. A delay in reporting may affect the available remedy to the extent that the delay prevents proper investigation or correction, but nothing in this clause removes any right that cannot lawfully be excluded. 

Travelodeal will forward relevant customer-service issues to the appropriate third-party Supplier and will reasonably assist the traveller in seeking a resolution. Our legal responsibility will depend on whether we acted as organizer, principal, agent or retailer for the relevant Service, the booking confirmation, applicable law and the circumstances of the complaint. Nothing in this clause excludes responsibility that cannot lawfully be excluded. 

 

Problems During Travel 

Any problem with accommodation, a cruise, transfer, tour or other Travel Service must be reported promptly to both the local Supplier and Travelodeal while the service is being used, ordinarily within 24 hours after you become aware of it. You must provide a reasonable opportunity to investigate and correct the issue. 

Leaving accommodation or a vessel, arranging replacement services, refusing a reasonable solution or waiting until after travel to report a remediable issue may affect any available remedy to the extent permitted by law. 

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by “unavoidable and extraordinary circumstances”, meaning any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease including any mutation or variation of, and  the ongoing effects of, Covid-19 or SARs-COV2, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned’s control.  

An unavoidable or extraordinary event affecting one destination, Supplier or Travel Service does not automatically cancel unaffected components of the booking. We may offer a reasonable change of date, route, airport, port, accommodation, vessel, destination or Supplier where this preserves the principal purpose of the trip. 

If the traveller elects not to travel while the contracted services remain available and lawful to perform, the request will be treated as a cancellation by the traveller under the applicable cancellation conditions. This does not limit any right that cannot lawfully be excluded. 

 

 

Effect on Individual Travel Services 

An unavoidable and extraordinary circumstance may affect only one part of an itinerary. Disruption to one Travel Service does not automatically cancel unaffected services. Where reasonably possible, we may propose a change of date, route, airport, port, hotel, villa, vessel, destination or Supplier, and any alternative may require a price adjustment. 

If you choose to cancel while the booked services remain available and lawful to perform, the cancellation will be treated as a cancellation by you under the applicable cancellation conditions. Nothing in this clause limits a mandatory refund or other consumer right. 

Some countries may require travellers to undergo a health check prior to boarding/entry and present proof of a negative COVID-19 test. In the event that either an air operator, hotel/resort or cruise line observes any COVID-19 symptoms, the operator may refuse boarding or entry. The traveller may, if in destination, need to self-isolate for a period of 14 days or until a medical certificate is presented that confirms that the symptoms that the traveller is exhibiting are not related to the COVID-19 virus. The traveller will be responsible for all cost associated if they are required to stay beyond their original departure date due to COVID-19 reasons. More countries are adding requirements so please be sure to verify what is required prior to your departure.

Special note on the situation of COVID-19:In the event that the destination country of the trip requires the presentation of a PCR test or any other necessary requirement for the trip, the costs related to it will be borne by the client, as well as the responsibility of doing it within the time required by the destination of the trip. In the event that the client, once the trip has started, presents any symptoms related to COVID and that results in a modification of the contracted services, (e.g. overnight stay, hotel or flight changes), the extra costs will be borne by the clients and the same must subsequently be claimed from their insurer.

Our responsibilities depend on whether the Booking Summary and/or Confirmation Invoice identifies Travelodeal as organizer, principal, retailer or agent. Where we are organizer or principal, we are responsible to the extent required by applicable law for proper performance of the included Travel Services. Where we are a disclosed agent, we are responsible for reasonable performance of our agency services and any direct statutory or merchant obligations, while the Supplier is responsible for providing its Travel Service. 

To the extent permitted by law, we are not responsible for loss caused by the Traveller, an unconnected third party whose conduct was unforeseeable or unavoidable, or unavoidable and extraordinary circumstances. We are not responsible for indirect or consequential consumer loss that was not reasonably foreseeable when the Booking was made. 

Baggage and personal effects remain the Traveller’s responsibility except where a carrier, Supplier or Travelodeal is liable under the Booking, applicable law or an international convention. We recommend appropriate baggage insurance and prompt reporting of loss to the responsible carrier or Supplier. 

We are not responsible for a Travel Service that is neither included in the Booking nor advertised or supplied by us, except where applicable law provides otherwise. Nothing in these Booking Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, or any consumer right or liability that cannot lawfully be excluded or limited. 

If in our reasonable belief or opinion or in the reasonable belief or opinion of any person in authority, your behaviour is jeopardising the safety of aircraft, people or property therein or good order and discipline on board; or is causing or is likely to cause distress, danger, damage or annoyance to any third party or property, or to cause a delay or diversion to transportation, we reserve the right to terminate your arrangements immediately. In the event of such termination our responsibilities to you will cease and you will be required to leave your accommodation or other service immediately. We will have no further obligations to you and will not meet any expenses, costs or losses incurred as a result. You may also be required to pay for loss and/or damage caused by your actions directly to the applicable supplier prior to departure from the service. If you fail to do so, you will be responsible for meeting any claims and costs subsequently made against us as a result. 

Travel documents including, without limitation, booking confirmations, are sent to you by electronic mail whenever possible. Paper documents may be sometimes necessary in which case the documents will be sent by priority mail. You may request paper documents instead of electronic documentation, in which case the passenger will pay the additional applicable charges. 

It is the responsibility of the customer to examine all itineraries, tickets and vouchers at the time of receipt. If there is an error or omission, it is the sole responsibility of the customer to immediately notify provider of the problem. Failure to do so, will result in provider charging a fee or refusing to modify documents. If errors and omissions occur, we reserves the right to cancel the reservation and refund monies collected. 

Flight times are not guaranteed and are subject to change. It is your responsibility to confirm your latest flight time with your carrier when your check-in prior to departure. Nonstop and single plane service are not guaranteed. International flights are subject to the respective foreign governments granting landing rights for the flights. If the air carrier cannot obtain these rights, the flight will be canceled and a full refund will be made to you automatically in the form of original payment. The air carrier and/or Travelodeal reserve the right to substitute other aircraft/airlines if necessary. We are not liable if there is any change to a departure or arrival time previously given to you or shown on your ticket. 

Travelodeal does not accept responsibility for lost wages, missed vacation time or any other additional expenses incurred as a result of changes in flight times. 

Nothing in these Terms limits any rebooking, refund, compensation or other right that applies under the Canadian Air Passenger Protection Regulations or other mandatory law. 

We recommend that all travellers purchase comprehensive Travel Insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a traveller is unable to provide details to authorities of insurance or denial of entry for any reason. 

Every effort is made to ensure brochure accuracy at the time of going to press, however Travelodeal cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances. Moreover, photographs and descriptions of locations or attractions are merely representative of conditions that existed at time of brochure printing and conditions may not be the same at the time of your journey. 

Supplier operational rules may apply to receiving or using the Travel Service when communicated by the Supplier or shown in the travel documents. A price, payment, cancellation, refund or change restriction may be enforced by Travelodeal only where it is contained in these Booking Conditions, included in the Booking Summary and/or Confirmation Invoice, or otherwise clearly communicated before acceptance. A general reference to Supplier conditions does not remove a mandatory consumer right. 

If you decide that you do not want to visit a country or part of a country you intended to visit because of any law, condition or requirement of any government or governmental authority, official, servant or agent, you are responsible for any costs, expenses, charges, fees, losses or damage incurred as a consequence and any cancellation or amendment fees. Neither Travelodeal nor any of its staff or agents, accepts any responsibility or liability for your acts, omissions, defaults, conduct, state of health, condition or circumstances.  

In the case of computer or human billing errors, we reserve the right to re-invoice participants with correct billing. 

Cruise and Premium Travel Risks 

Cruises, river cruises, yachts, private transfers, safaris and destination experiences may involve changing weather, water levels, navigation restrictions, wildlife, remote locations, differing safety standards and limited medical or evacuation facilities. Travellers must follow all Supplier safety, health, age, mobility, pregnancy, conduct and equipment requirements. 

The traveller is responsible for timely embarkation and for reaching the required departure point. A missed embarkation, missed port or itinerary adjustment does not automatically create a right to cancel the whole booking or receive a refund, except where required by applicable law. 

A named vessel, port, route, sailing time, docking location, cabin number, deck, position, view, dining time, excursion or itinerary sequence is not guaranteed unless expressly confirmed as guaranteed in writing. The cruise operator may omit, replace or resequence ports and excursions, substitute a vessel or cabin, or alter the route for navigation, weather, water level, safety, technical, health, port, government or operational reasons. 

Where a reasonably comparable cruise, vessel, cabin, port arrangement or itinerary is provided, the change will not ordinarily entitle the traveller to cancel unaffected services or receive a refund for the entire booking. Any mandatory statutory right remains unaffected. 

Cruise-line conditions of carriage, health rules, pregnancy restrictions and embarkation requirements may apply when communicated by the cruise line or shown in the travel documents. A cruise-specific price, payment, cancellation, refund or change restriction may be enforced by Travelodeal only where it is included in these Booking Conditions, the Booking Summary and/or Confirmation Invoice, or otherwise clearly communicated before acceptance.

Photographs or pictures appearing on the web site should be used solely as an indication of facilities and attractions. Actual facilities and attractions may vary according to itinerary. Maps shown are current at the time of printing and may not reflect the actual tour routing should the itinerary change. 

Luxury Images, Ratings and Descriptions 

The words luxury, premium, exclusive, boutique, five-star, VIP and similar descriptions may reflect local, Supplier or industry standards and do not guarantee that every feature or service style will match an individual traveller’s expectations. 

Photographs, videos, renderings, floor plans and sample layouts are illustrative unless the exact feature is expressly guaranteed in the booking confirmation. Differences in décor, layout, furnishings, vegetation, beach or sea conditions, weather and seasonal facilities do not by themselves establish that a Travel Service was inaccurately described. 

Unless expressly guaranteed in writing, room or villa number, building, floor, wing, location, view, bedding, terrace, pool, beach proximity, privacy, sunlight, connecting rooms, early check-in, late check-out, upgrades and complimentary amenities are requests only and remain subject to Supplier allocation and availability. 

A difference in décor, layout, room position, view, beach access, vegetation, seasonal amenity or service style does not by itself establish a downgrade where the confirmed category and the overall standard and value remain reasonably comparable.

Security Deposits and Property Rules 

Villas, private residences, yachts and similar services may require security deposits, payment-card pre-authorizations, damage waivers, identification, occupancy limits and compliance with house or vessel rules. You are responsible for charges arising from damage, excessive cleaning, smoking, prohibited events, unauthorized guests or breach of Supplier rules.
